On Saturday, 10th April 2004 at 10.08 a.m., I called Mr. George Otieno on his cell phone from my cell phone and notified him that that I had been robbed of the cell phone that Pulin Shah gave me on 15th December 2003. Mr. Otieno said that this was understandable.
On Wednesday 14th April 2004 Pulin Shah called me on my cell phone at 12.06 p.m. He told me he was with the “forgers”, and needed me to SMS him the names of Suresh Jasraj Seth, holder of EABL shares account No. XXXXXXXX to avoid them making a spelling mistake. I told him I would do this within an hours time of 12.06 p.m., Wednesday, 14th April 2004. Mr. Shah also wanted he and me to meet for a drink the following day, 15th April 2004 and said he would call me on Thursday morning, 15th April 2004 to confirm. I reported this to the Head of Registrar Services who found it odd that Mr. Shah would be making a request for the exact spelling of the names of Suresh Jasraj Seth at this late stage. The Head of Registrar Services nevertheless told me to SMS Mr. Shah the names of Suresh Jasraj Seth.
Soon after this I called Mr. Otieno on his cell phone from my cell phone to notify him that Mr. Shah had contacted me. The line was unclear and I therefore told Mr. Otieno that I would call him later. I however sent Mr. Otieno an SMS at 12.22 p.m. on 14th April 2004 whose exact wording was “Sema George, This is Mundia Kamau of BARS. Pulin Shah has called me today 14/04/2004, and wants me & him to meet tomorrow, 15/04/2004.” At 12.29 p.m. on Wednesday, 14th April 2004, I also sent Mr. Shah an SMS whose only content was the names Suresh Jasraj Seth.
At 1.49 p.m. on 14th April 2004, I again called Mr. Otieno on his cell phone from my cell phone. He told me he had received my SMS of 12.22 p.m., Wednesday 14th April 2004 and told me he would call me when he got back to the office. He was not in his office at the time I called him at 1.49 p.m. on Wednesday, 14th April 2004
Mr. Shah did not call me as pledged on Thursday, 15th April 2004. I however called Mr. Shah at 7.58 p.m. on Thursday evening, 15th April 2004, to ask Mr. Shah why he had not called me. Mr. Shah told me that he had been busy the whole day attending to other matters at the Attorney General’s Chambers, and told me he would call me the following day, Friday, 16th April 2004.
Mr. Shah did not call me on Friday, 16th April 2004 as pledged.
