On Monday morning, 19th April 2004 I took the Head of Registrar Services my report of 18th April 2004 and he asked me if there had had been any new developments. I told him that Mr. Shah and I had not communicated since Thursday evening, 15th April 2004.
Later on in the morning, the Head of Registrar Services asked me to call Mr. George Otieno. I did this at 1.47 p.m. by calling Mr. Otieno on his cell phone from my cell phone. Mr. Otieno asked me to call him instead on his office landline i.e. XXXXXX extension XXX. I could not get through after several attempts and even called the Bank House switchboard for an alternative number and was told there wasn’t one and was advised to keep on trying as it was at times problematic to get through.
After a few other unsuccessful attempts to reach Mr. Otieno on his office land line XXXXXX extension XXX, I sent Mr. Otieno an SMS to his cell phone from my cell phone at 2.46 p.m. on Monday, 19th April 2004. The exact wording of the SMS was “George, This is Mundia Kamau of BARS. I can’t get through to you on Tel. XXXXXX
On Friday, 23rd April 2004 Dr. Harrop called me at 10.14 a.m. in the morning on my cell phone. He told me that he was calling me from London. The number Dr. Harrop was calling me from was undisclosed on my cell phone and I could therefore not note it. Dr. Harrop told me that he had arranged for “the response” of Suresh Jasraj Seth, holder of EABL shares account No. XXXXXXXX, to be delivered to the office of Barclays
Advisory and Registrar Services Limited at 11.00 a.m. on Friday, 23rd April 2004 (see report of 18th April 2004 and 26th March 2004). He also apologetically told me that Mr. Shah and I had not been able to meet (again see report of 18th April 2004), because of Mr. Shah’s tight schedule. Dr. Harrop however told me that he would be in Kenya in the week of 25th April 2004 to 1st May 2004, and hoped that he and I could meet on either Wednesday, 28th April 2004 or Thursday, 29th April 2004.
Soon after I got off the phone with Dr. Harrop, I reported Dr. Harrop’s conversation with me to the Head of Registrar Services.
