Re: [Jambo] THE PEOPLE'S CONSTITUTION REVIEW PROCESS - RESOLUTIONS From: NCEC Peoples' Constitutional Review Process Conference (PCRP) Tuesday, April 24, 2007 at Kenyatta International Centre (KICC) The first Peoples' Constitutional Review Process Conference convened at the KICC on April 24, 2007, assembled people and diverse sectors including: * The professional societies * The private sector * The women constituency * The youth constituency * Persons with disability * Trade unions * Workers organizations * Social and constitutional Movements * Non Governmental Organizations * Community Based Organizations * Minorities * Pastoralists * The religious sector * Non-parliamentary political parties * The CSOs in governance * The children sector * The senior citizens * Students * Academicians * Artists * Individual citizens We assembled to deliberate and establish the people-centered constitution review process and to ensure its completion, affirm and resolve as follows: RECOGNIZING THAT the comprehensive review of the constitution is urgent and knowing that we the people of Kenya are the drivers of reforms and have sacrificed our lives and will to realize a new and just constitutional order in Kenya; INTERESTED in fair elections that increase representation of the marginalized people especially the women, persons with disability in Kenya and other minorities, workers, young people; HAVING deliberated and condemned the attempts by the parliament to dictate, manipulate, stage manage and bar other Kenyans from the decision making on the dialogue on the essential reforms and road map towards the conclusion of reforms; APPRECIATING THAT Inclusion and is a fundamental and essential factor in building trust and a key good will benchmark; WHILE FURTHER APPRECIATING THAT Inequitable use of power should not be used to marginalized the women, minorities and persons with disabilities DO HEREBY RESOLVE 1. THAT we shall proceed informed by the concurrence principle where we shall ensure that our essential reforms are enacted first lay the foundation and the roadmap for the comprehensive Constitutional reforms that is people driven and accepted by all people. 2. THAT We shall convene an alternative process led by the people of Kenya that shall incorporate MPS as citizens not as an MP. 3. THAT WE MUST SPEAK a language that Kenyans can relate to. 4. THAT we must mobilize the people of Kenya against Parliamentary dictatorship and reject it totally. 5. THAT we shall mobilize masses within the constituencies named to participate in the people's process. 6. THAT We shall take steps to ensure that no reform talks shall happen without our integral, equal and substantive participation from the onset. We shall not act as rubber stamps to the wishes of the parliamentarians; 7. THAT the JDF is hereby adopted as the forum that shall steward the peoples' constitutional review process. The JDF shall organize all the sectors into a forceful reform force that shall ensure that the country gets a new constitutional dispensation by December 2008. 8. THAT as citizen groups we shall work amplify, facilitate the representation of the people in constitution making through engaging the people of this society through mobilization of our various sectors and networks countrywide. 9. THAT the JDF has resolved to take steps to ensure that Parliament does not go ahead with its coup against the people and their sovereignty to make their constitution. 10. That JDF has resolved that the Essential reforms be enacted before budget day 2007 and that Comprehensive review must commence in July 2007 and the referendum held by December 2008.
