ODM will not seek court intervention due to the belief that the court is prejudiced as a result of Kibaki appointees.
 
Who will sue for the fraudulent election?
 
Kivuitu cannot sue due to the real threats he is subjugated to.
 
However futile the prospects of victory are, someone nust bring a case agaist those who meddled with the most important civil process in a democracy.
 
Kivuitu and other commisioners have asked for an independent body to investigate the elections. Somewhere they can confess, report or vindicate their actions.
 
Other than ODM and Kibaki, it is LSK and KHRC that can seek legal intervention.
 
Their action is needed now, before witnesses die like those in the Ouko murder mystery!

Following the breakdown of the mediation process,
Kenya's piece is as fragile as an air bubble.
 
Change is elusive, but can be realized quickly with peaceful demonstartion, quicker through active civil disobedience, and quickest with lots of bloodshed.
 
 
Those afflicted most as a result of the stolen election will do whatever it takes to prevent oppression.
 
The western powers including the EU and USA have strategically pesponded indicicively.
 
May God guide us to make the best decisions.

Personally, I wish Kivuitu can simply tell what really is going on. The more he delays in telling the truth, somewhere in Kenya a life is needlessly lost. Kivuitu knows this. His silence therefore is too loud. We can hear his heartbeat thousands of miles away.
